Terms of Use for the Face Recognition Feature

Article 1 (Application)
1. These Terms set out the conditions for using the face recognition feature (the "Feature") provided by TicketMe Inc. (the "Company").2. In addition to these Terms, the Company's Terms of Use and the "Handling of Facial Information" apply to the use of the Feature. If these Terms conflict with the Terms of Use, these Terms shall prevail.
Article 2 (Definitions)
1. The "Feature" means the function that verifies identity at entry by matching the facial feature data generated from a face image registered in advance by the user against a face image captured by a camera at event entry.2. "Facial Information" collectively means face images and facial feature data (data generated from a face image that numerically expresses facial characteristics and serves as a code for authenticating the individual).3. A "Face Recognition Ticket" means a ticket that is indicated on its sales page as a ticket using entry by face recognition. Whether entry by face recognition is mandatory or optional is indicated on the sales page for each ticket.
Article 3 (Registration)
1. A user who wishes to use the Feature shall register their own face image by the method prescribed by the Company.2. Only the user's own face image may be registered. Registering another person's face image is not permitted.3. The face image must meet the requirements set by the Company (facing front, not wearing a hat, sunglasses, mask or similar, no image editing, etc.). If the requirements are not met, the Company may decline the registration or ask the user to register again.4. Registration for the Feature is free of charge. However, communication charges shall be borne by the user.
Article 4 (Validity Period and Renewal of Registration)
1. The validity period of a face recognition registration is two years from the date of registration or renewal.2. Users may renew their registration by the method prescribed by the Company. While the user holds a valid Face Recognition Ticket, renewal may be performed only if identity is confirmed by matching against the registered Facial Information.3. When the validity period elapses, the face recognition registration lapses. A user who does not hold a valid Face Recognition Ticket may use the Feature again by registering a new face image.4. If the date of an event for a Face Recognition Ticket falls after the expiry of the registration, the Company may ask the user to renew the registration at the time of purchasing that ticket.
Article 5 (Use of the Feature and Face Recognition Tickets)
1. For tickets that are not Face Recognition Tickets, registration for the Feature is not required, and users may enter by the ordinary method specified for the ticket (such as presenting a QR code).2. Whether a ticket is a Face Recognition Ticket, and whether entry by face recognition is mandatory or optional, is indicated on the ticket sales page before the purchase procedure is completed.3. Purchasing a Face Recognition Ticket, and receiving one by transfer, requires that registration for the Feature has been completed in advance. Where entry by face recognition is mandatory, the user shall enter by face recognition.4. For Face Recognition Tickets where entry by face recognition is optional, users may enter either by using the Feature or by the ordinary method.5. Users can choose whether to use the Feature through their decision whether to purchase a Face Recognition Ticket.6. A user who receives a Face Recognition Ticket by any method outside the Company's service cannot use that ticket (including entry, transfer and resale) until registration for the Feature is completed.
Article 6 (Entry by Face Recognition)
1. A user using the Feature shall hold their face up to the camera of the terminal installed at the venue upon entry.2. Entry is permitted where identity is confirmed as a result of matching.3. If identity cannot be confirmed by matching, the Company, the organizer (including those who plan, hold, operate or manage the event) or a business entrusted by the organizer with event operation, entry management or similar work (including its subcontractors) may verify identity by presentation of identification documents or other means. Users agree to this in advance.4. Face recognition is a technology based on the similarity of facial characteristics, and the Company does not warrant that matching is always accurate. Even in the case of a matching error, entry is permitted if identity can be confirmed by the method in the preceding paragraph.
Article 7 (Prohibited Acts)
Users shall not engage in the following acts when using the Feature.(1) Registering another person's face image, or causing another person to register the user's own face image(2) Registering Facial Information using multiple accounts(3) Using or attempting to use the Feature while impersonating another person(4) Attempting to deceive matching using photographs, video, masks or similar(5) Unauthorized access to, analysis of, or other interference with the operation of the systems of the Feature
Article 8 (Deletion of Registration, Withdrawal of Consent, and Account Closure)
1. Users may delete their registration of Facial Information from My Page and withdraw their consent to the collection and use of Facial Information. However, while the user holds a valid Face Recognition Ticket, the user cannot delete the registration themselves from My Page, because it is necessary to prevent unauthorized ticket resale.2. Notwithstanding the proviso in the preceding paragraph, if a user closes their account, the Company will erase the user's Facial Information without delay, regardless of whether they hold tickets. However, for a person whose account has been forcibly terminated on grounds such as unauthorized use of the Company's services, including a violation of the Terms of Use, the provisions of Article 4, paragraph (5) of the "Handling of Facial Information" apply.3. Where a registration is deleted or consent is withdrawn, the Company will erase the user's Facial Information without delay in accordance with the "Handling of Facial Information". A user who has deleted their registration cannot purchase, or receive by transfer, a Face Recognition Ticket unless they register for the Feature again.
Article 9 (Modification and Suspension of the Feature)
In the event of system maintenance, failure, natural disaster or other unavoidable circumstances, the Company may modify, suspend or terminate all or part of the Feature. In such cases, the Company or the organizer will provide an alternative means of entry, such as presentation of a QR code.
Article 10 (Disclaimer)
The Company shall be liable for damages incurred by a user arising from the use or inability to use the Feature only for ordinary and direct damages actually incurred by the user, except where the Company has acted with intent or gross negligence.
Article 11 (Changes to These Terms)
The Company may change these Terms in accordance with the provisions on changes set forth in the Terms of Use. The revised terms will be announced by posting on the Company's website or by other appropriate means.
Article 12 (Governing Law and Jurisdiction)
The governing law and jurisdiction for these Terms shall be as provided in the Terms of Use.
