Terms of Use

These terms of use (hereinafter referred to as 'these Terms') set forth the conditions for using the services provided on this website (hereinafter referred to as 'the Services') by Chikamee Co., Ltd. (hereinafter referred to as 'the Company'). Registered users (hereinafter referred to as 'Users') shall use the Services in accordance with these Terms.
Article 1 (Application)
These Terms shall apply to all relationships related to the use of the Services between Users and the Company.
In addition to these Terms, the Company may establish various rules for use, etc. (hereinafter referred to as 'Individual Provisions') regarding the Services. These Individual Provisions, regardless of their name, shall constitute a part of these Terms.
In the event of any inconsistency between the provisions of these Terms and the Individual Provisions, the Individual Provisions shall prevail unless otherwise specified in the Individual Provisions.
Article 2 (Prohibited Matters)
Users shall not engage in the following acts when using the Services:
Acts that violate laws or public order and morals
Acts related to criminal activities
Acts that infringe copyrights, trademark rights, and other intellectual property rights included in the Services
Acts that destroy or interfere with the functions of the Company's, other Users', or third parties' servers or networks
Commercial use of information obtained through the Services
Acts that may interfere with the operation of the Company's services, particularly sending large amounts of requests
Unauthorized access or attempts to do so
Collecting or accumulating personal information, etc. about other Users
Using the Services for fraudulent purposes
Acts that cause disadvantage, damage, or discomfort to other Users or third parties
Impersonating other Users
Advertising, promoting, soliciting, or conducting business on the Services without the Company's permission
Acts aimed at meeting unacquainted opposite sex
Providing benefits directly or indirectly to antisocial forces in connection with the Company's services
Other acts that the Company deems inappropriate
Article 3 (Suspension of Provision of the Services, etc.)
The Company may suspend or discontinue the provision of all or part of the Services without prior notice to Users if it determines that any of the following circumstances apply:
When performing maintenance, inspection, or updating of the computer system related to the Services
When it becomes difficult to provide the Services due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
When the computer or communication lines, etc. stop due to an accident
Other cases where the Company determines that it is difficult to provide the Services
The Company shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or interruption of the provision of the Services.
Article 4 (Usage Restrictions and Deregistration)
The Company may restrict the use of all or part of the Services or deregister Users without prior notice if any of the following apply:
Violation of any provision of these Terms
False information found in registration details
Default of payment obligations such as fees
No response to communication from the Company for a certain period
No use of the Services for a certain period since the last use
Other cases where the Company determines that the use of the Services is inappropriate
The Company shall not be liable for any damage caused to Users as a result of actions taken by the Company based on this article.
Article 5 (Disclaimer and Warranty Disclaimer)
The Company does not warrant that the Services are free of factual or legal defects (including safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc., errors, bugs, and rights infringements).
The Company shall not be liable for any damages incurred by Users due to the Services, except in cases of intentional or gross negligence by the Company. However, if the contract between the Company and Users regarding the Services (including these Terms) is a consumer contract as defined by the Consumer Contract Act, this disclaimer shall not apply.
Even in cases where the disclaimer does not apply, the Company shall not be liable for any special damages arising from the circumstances (including cases where the Company or Users foresaw or could have foreseen the occurrence of damages) due to the Company's negligence (excluding gross negligence). Furthermore, compensation for damages incurred by Users due to the Company's negligence (excluding gross negligence) shall be limited to the amount of usage fees received from Users in the month the damages occurred.
The Company shall not be involved in or responsible for any transactions, communications, or disputes that arise between Users and other Users or third parties regarding the Services.
Article 6 (Changes to Service Content, etc.)
The Company may change, add, or discontinue the content of the Services with prior notice to Users, and Users shall accept these changes.
Article 7 (Changes to the Terms of Use)
The Company may change these Terms without the individual consent of Users in the following cases:
When the changes to these Terms are in the general interest of Users
When the changes to these Terms do not contradict the purpose of the usage contract and are reasonable considering the necessity of the changes, the reasonableness of the changed content, and other circumstances related to the changes
The Company shall notify Users in advance of the changes to these Terms, the contents of the changed Terms, and the effective date of the changes.
Article 8 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer or provide as collateral their contractual status or rights or obligations under these Terms to third parties without prior written consent from the Company.
Article 9 (Transfer of Rights to Goods or Services)
Users acknowledge that the rights to goods or services sold or purchased within the Company's services can be transferred to third parties.
Article 10 (Agreement on Discontinuation of Sales)
Users agree that if the primary seller fails to fulfill their obligations regarding the goods or services sold within the Company's services, the primary seller is obligated to repurchase the goods or services at the original sale price.
Article 11 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan.
Any disputes arising in connection with the Services shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company's head office.
Article 12 (Handling of Personal Information)
The Company shall appropriately handle personal information obtained through the use of the Services in accordance with the Company's 'Privacy Policy'.
